1. Acceptance of Terms

By accessing or using HavaHR ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

HavaHR is a cloud-based HR management platform designed for Malaysian businesses. Our services include employee management, payroll processing, leave management, attendance tracking, expense claims, and HR document generation.

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account
  • You must notify us immediately of any unauthorized access
  • One person or entity may not maintain multiple free accounts

4. Subscription and Payment

  • Free tier includes limited features as described on our pricing page
  • Paid subscriptions are billed monthly in Malaysian Ringgit (RM)
  • Payments are processed securely through Stripe
  • Subscriptions auto-renew unless cancelled before the billing date
  • Refunds are handled on a case-by-case basis

5. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Upload false or misleading employee data
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Resell or redistribute the Service without permission
  • Use automated systems to access the Service excessively

6. Data Ownership

You retain ownership of all data you upload to HavaHR. We do not claim any ownership over your employee data, documents, or other content. You grant us a license to use this data solely to provide and improve our services.

7. Statutory Calculations

While we strive to provide accurate calculations for EPF, SOCSO, EIS, and PCB based on current Malaysian regulations, you are responsible for verifying all calculations and submissions to statutory bodies. HavaHR is not liable for any errors in statutory contributions or tax calculations.

8. Service Availability

We aim to provide 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for any downtime or service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, HavaHR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Service.

10. Termination

We may suspend or terminate your account for violation of these terms. You may cancel your account at any time. Upon termination, you may request export of your data within 30 days.

11. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Malaysia.
